Can You Go to Jail for False Accusations in North Carolina?

What Is a False Accusation?

Under North Carolina law, a person can be charged with making a false accusation if they willfully intended to mislead law enforcement or interfere with law enforcement’s ability to do their job. The exact statute definition regarding false accusations can be seen here:

“…any person who shall willfully make or cause to be made to a law enforcement agency or officer any false, deliberately misleading or unfounded report, for the purpose of interfering with the operation of a law enforcement agency, or to hinder or obstruct any law enforcement officer in the performance of his duty…”

Penalties for Making a False Accusation

If you are found guilty of making a false accusation, you could be charged with a Class 2 misdemeanor. This is punishable by up to sixty days in jail and fines of as much as $1,000. 

However, if the false accusation pertained to the welfare of a child (i.e. a child’s disappearance), the person who made the accusation could face Class H felony penalties which include fines and imprisonment for up to twenty-five months.
