Keeping Quiet: Protect Your Rights

One of the best things you can do when arrested – in addition to calling a top criminal lawyer Raleigh – is to keep your mouth shut. If the police ask you a question, be polite and respectful, but decline to answer.

I’ve talked about this a lot on this website before, but even if you are completely innocent of the crime, you should never talk to police without an Raleigh criminal defense lawyer present.

That’s doubly important in drug cases. If you’re charged with a drug trafficing offense in Wake County or other parts of North Carolina, you are facing mandatory minimum sentences. These sentences require a judge to sentence you to 5 to 7 years or more, depending on the kind of drug and the quantities involved.

The judge has virtually no discretion!

However, the judge CAN sentence you to less than the mandatory minimum if the police agree that you have given them “substantial assistance” leading to the arrest and conviction of other people involved in the drug transaction.

Now, maybe you don’t want to give substantial assistance – “snitch” – but here’s what I can tell you:

If you talk to the police during your arrest and tell them everything you know before you have a deal, you may have no option of giving substantial assistance later. The police will already know everything because you already told them.

So don’t give away information for free. Keep it to yourself. Let your drug lawyer Raleigh work out a deal with the prosecutor before you start talking, if that’s what you want to do.
